Cases

Real operations and what could have happened without analysis.

All of them happened. Here we show how each situation was handled: what came up, what was done and how it ended.

The five case studies on video

Case 1Imports

Import with an Inmetro requirement

  1. The situation

The client came to us when the goods had already been shipped and, during the analysis of the operation, it was identified that the product required Inmetro certification.

  2. What could have happened

Without proper handling, the operation could have resulted in retention of the goods, high costs and even total loss of the cargo.

  3. How we handled it

We analyzed the applicable legislation, structured the regularization process and conducted the import within the legal possibilities.

  4. The result

The result was the release of the goods and the containment of a significant loss in an operation that was already at risk.

Case 2Exports

Export to Mercosur

  1. The situation

During an export to Mercosur, we identified that certain products could not proceed in the operation as initially planned, because the legislation of the destination country required a prior license for the import of these items.

  2. How we handled it

Before filing the export customs clearance, we reviewed the documentation and identified the products that could compromise the operation. These items were removed from the shipment, allowing the main export to proceed within the expected timeframe and without creating additional obstacles for the importer in the destination country.

  3. The result

The result was an operation conducted with greater security, avoiding bureaucratic risks for the client abroad and helping to preserve the commercial relationship between exporter and importer.

Case 3Imports

Import in the grey channel

The dreaded grey channel.

17tax authority questions answered

  1. The situation

In a highly complex import, the operation was subjected to an in-depth inspection by the Receita Federal (Brazil's Federal Revenue Service), with requirements for detailed proof regarding the negotiation, the goods and the accuracy of the information provided.

  2. How we handled it

17 tax authority questions were answered, supported by consistent technical documentation and appropriate justifications. We guide clients so that their operations are structured in terms of documentation and prepared for any customs inspection proceedings.

  3. The result

In this case, the result was the regularization of the operation, the release of the goods and the closing of the proceeding without any penalties.

More than resolving a requirement, the case demonstrated the importance of keeping each stage of the import properly documented, consistent and technically grounded.

Case 4Imports

Incorrect description of the goods

  1. The situation

We identified that the description provided by the supplier did not adequately meet the tax and customs requirements applicable to the operation.

  2. What could have happened

An incomplete or inaccurate description could result in inadequate tariff classification, incorrect taxation, additional requirements, fines and even retention of the cargo.

  3. How we handled it

Before the operation was registered and the goods were released by customs, we reviewed the information together with the client, who holds the technical knowledge of the goods, their application, function and intended use. Based on this information, we adjusted the product description, making it possible to validate with greater certainty the tariff classification, the administrative treatment and its attributes, and the applicable requirements before registration in the system.

  4. The result

The result was an operation conducted with greater security, compliance and predictability and, above all, a customs release without any setbacks.

Case 5Exports

Foreign exchange discrepancy between head office and branch

  1. The situation

In an export operation, we identified that the commercial invoice had been issued in the name of the head office, while the operation's nota fiscal (Brazilian tax invoice) had been issued by the branch. This discrepancy required attention, since the commercial, tax and financial documentation of an export must be correctly structured and allow the operation to be properly identified and linked.

  2. What could have happened

If not properly analyzed and addressed, the inconsistency could create difficulties in reconciling the payment received, proving the operation and presenting information to financial institutions and the competent authorities.

  3. How we handled it

We identified the discrepancy and advised the company, together with its team, on the need to review the operation and adopt the appropriate procedures to ensure consistency between the export documentation and the corresponding financial flow.

  4. The result

The result was the adjustment of the operation and a reduction in the risk of documentary, tax and foreign exchange inconsistencies.

Because, in foreign trade, every document must be aligned with the reality of the operation.
